Following is the text of the most recent statement James Hardie has issued on asbestos compensation: 9 February 2007 James Hardie pays initial A$184.3 million to AICF An initial payment of A$184.3 million was made to the Asbestos Injuries Compensation Fund (AICF) by James Hardie today in accordance with the long-term funding arrangements endorsed by security holders on 7 February 2007. The transfer of the initial payment satisfies the final condition precedent to the Amended and Restated Final Funding Agreement (Amended FFA). The commencement date for the Amended FFA becoming fully operational is 9 February 2007. The first annual payment is due on 1 July 2007. The AICF will now assume the role of processing asbestos-related personal injury claims made against certain former James Hardie group subsidiaries. James Hardie Chairman Meredith Hellicar said: "We are delighted to have made the first payment to the Fund under the agreement supported by our security holders this week. Like many, we have been looking forward to making this a reality for a long time". 15.05.06 Results for Q4 and Full Year FY06 - Full year operating profit excluding asbestos provision up 63% to US$208.9 million - Asbestos provision recorded
James Hardie today announced that its 4th quarter and full year results have been substantially affected by the recording of a net provision for estimated future asbestos-related compensation payments (asbestos provision) of US$715.6 million at 31 March 2006.
The asbestos provision contributed to a decrease in operating profit from continuing operations for the three months ended 31 March 2006, down from US$46.3 million in fiscal year 2005 to a loss of US$650.9 million. For the full year, the operating profit from continuing operations fell from US$127.9 million in fiscal year 2005 to a loss of US$506.7 million.
For the 4th quarter, operating profit from continuing operations, excluding the asbestos provision of US$715.6 million, increased 40% compared to the same quarter last year, to US$64.7 million. The strong 4th quarter operating performance lifted the full year operating profit from continuing operations, excluding the asbestos provision, by 63% to US$208.9 million.

25.10.04 Statement James Hardie Industries NV today wrote to the Medical Research and Compensation Foundation reaffirming its preparedness to provide assistance regarding the MRCF's interim liquidity position.
James Hardie also expressed its surprise at the apparent immediacy of the MRCF's claims. The MRCF only last month rejected as no longer necessary James Hardie's offer to provide interim financial assistance, following an approach from the MRCF that it was approaching a liquidity issue in late August. James Hardie has written to the editor of The Australian in response to Ean Higgins' article "Indemnity for Hardie directors 'unlawful'" which appeared in the Australian on 4 October 2006. Mr Higgins is wrong in asserting that James Hardie is acting unlawfully by providing indemnity to current and former officers who may be under investigation by ASIC. Indemnities for the purpose described in the company's Form 20-F are standard corporate practice and in James Hardie's case specifically limit indemnification to what is permitted by law. It is a valid question and it received a considered response indicating the rationale behind the company’s planned board renewal.

It is a matter of public record that Ms Hellicar attended the initial meeting with the ACTU, Unions NSW and asbestos support groups in early October 2004. Since that time, all negotiations have been undertaken by management and advisers on behalf of the company. At no stage has any non-executive director, including Ms Hellicar, attended or been involved in negotiations with the NSW Government, the ACTU, Unions NSW or asbestos support groups. In addition, no non-executive director, including Ms Hellicar, has been involved in discussions with ASIC on the subject of releases or extinguishments of liability.

James Hardie has written to the Editor of the Sydney Morning Herald in response to journalist Michael Evan's article in the CBD column on Thursday 8 September 2005, "Hardie can spend loot on victims". Mr Evans suggests that, "Perhaps the group could redirect a few extra bucks it makes out of contracts in Louisiana, Mississippi and other hurricane affected areas to its asbestos victims?"
Mr Evans appears not to have noticed that James Hardie agreed, in December 2004, the commercial principles of a deal which will have exactly the effect he is advocating.

In his article, Mr West ignored the facts and reiterated a rumour created by The Australian newspaper that James Hardie is looking to leave Australia. Mr West's assertion that "Team Hardie is set to be working up another restructuring. This time, the aim is to sell off the Australian business to fund the compo payout while relisting in the US," is false and unsupported.
