If 25% of your James Hardie dividend was withheld as Dutch withholding tax, you may be entitled to a refund of part of this tax. The following information is provided to alert you to the opportunity to claim a refund of this tax from the Dutch tax authorities. Refunds cannot be made by James Hardie.
Your entitlement to a refund, and the amount of that refund, will depend on your country of residence for tax purposes. Please see the table below for further information:
If you are: A Custodian is an Australian resident who is the registered holder of a James Hardie CUFS and holds these CUFS on behalf of another person. The Custodian must be able to identify the number of CUFS held on behalf of the other person as at the Dividend Record Date. A trustee of a trust (except a bare trustee) is not a Custodian because the trustee would not hold the James Hardie CUFS on behalf of a specific person.
If you have completed and lodged a Form A with Computershare and 15% of your James Hardie dividend was withheld as Dutch withholding tax, you are NOT entitled to a tax refund from the Dutch tax authorities.
PLEASE NOTE THAT THIS INFORMATION IS PROVIDED AS A GUIDE ONLY. IT IS NOT INTENDED AS ADVICE AND SHOULD NOT BE RELIED ON AS SUCH. IT IS BASED ON DUTCH WITHHOLDING TAX LAWS & TREATIES AS AT 31 OCTOBER 2002. IF YOU ARE IN ANY DOUBT ABOUT YOUR TAX POSITION, OR WHETHER YOU CAN CLAIM A REFUND OF DUTCH TAX, YOU SHOULD CONSULT YOUR OWN TAX ADVISER.
